1. Service provider and contact
Growwwy is a subscription software service offered under the Growwwsites brand by Media&Business Consulting Kft. (the “Service Provider”).
- Registered legal name: Media&Business Consulting Kft.
- Registered office: 1037 Budapest, Harang utca 12., Hungary
- Hungarian company registration number: 01-09-989825
- Hungarian tax number: 24086844-2-41
- Service and legal contact: elemer@growwwsites.com
The Service Provider is responsible for the Growwwy software service, accounts and data access as set out in these Terms. For payments processed through Stripe Managed Payments, the separate merchant-of-record arrangements described in Section 5 apply.
2. Scope and eligibility
These Terms govern access to the Growwwy workspace, its marketing data connections and its remote MCP functionality. Growwwy is designed primarily for business and professional use. By registering on behalf of an organisation, you represent that you are authorised to bind it.
These Terms do not remove mandatory consumer protections where those apply. If you are subscribing as a consumer rather than for business use, contact us before completing payment so that the applicable disclosures and rights can be confirmed.
3. Accounts, access and authorised users
You must provide accurate account and billing information, keep credentials confidential, and promptly notify us if you suspect unauthorised access. You are responsible for actions taken by authorised members of your workspace, subject to applicable law.
Your selected plan defines the number of websites, connected data resources and team members available. We may block actions exceeding plan limits rather than silently charge overages. The limits displayed in the workspace are part of the applicable plan description.
4. 14-day trial and automatic renewal
Important payment disclosure: The 14-day free trial begins only after you complete Stripe Checkout and provide an accepted payment method. Email verification or creating an account does not itself start the trial.
If you do not cancel before the trial ends, the selected subscription automatically continues as a paid monthly subscription. Stripe will attempt to charge the applicable monthly price and any taxes shown at Checkout. You authorise this recurring billing by completing the Checkout.
During the trial, you can cancel through the subscription management link available in the workspace or the applicable Stripe/Link customer portal. Cancellation before the end of the trial prevents the first monthly subscription charge. A failed payment may restrict access until payment is resolved.
5. Plans, prices, taxes and payment processing
Published base prices are Starter €39/month, Pro €99/month and Agency €249/month. Current limits and plan descriptions are published at Pricing. Any applicable tax, the final amount payable, renewal terms and billing disclosures are presented at Checkout before confirmation.
Merchant of record for Managed Payments transactions. Where a purchase is processed through Stripe Managed Payments, Stripe, through Sold through Link, LLC or the applicable Stripe Managed Payments entity, acts as merchant of record for that transaction under its applicable terms. For eligible transactions in supported jurisdictions, that entity handles relevant indirect taxes (including VAT, GST or sales tax), covering applicable tax determination, calculation, collection, filing and remittance. It also handles payment processing, transaction receipts and applicable billing documents, fraud and dispute handling, and transaction-level support in accordance with its contractual scope. The payment provider’s Checkout disclosures and applicable customer terms apply to those transaction-related matters.
EU business purchases. VAT treatment follows the law applicable to the specific transaction and verified customer details. A qualifying cross-border EU business transaction may be subject to reverse-charge VAT, in which case the business buyer accounts for VAT where required by law. Other purchases may be charged applicable VAT. Customers should provide accurate business and tax identification details in Checkout; the applicable tax treatment is shown on the transaction documents.
Growwwy service obligations. Media&Business Consulting Kft. remains responsible for the provision, operation and support of the Growwwy software, the agreed features, management of data connections, personal-data obligations and its own tax, accounting and reporting responsibilities. Stripe Managed Payments does not transfer every legal, product, privacy or corporate-tax obligation to Stripe. Where a transaction is not processed through Stripe Managed Payments, the merchant-of-record and tax responsibilities may differ and are governed by the actual Checkout arrangements and applicable law.
We may change prices prospectively with appropriate notice and any choices or protections required by law. We do not unilaterally apply a higher price to a billing cycle already paid for.
6. Cancellation, refunds and account closure
You can request cancellation at any time using the available billing portal or by contacting support if the portal is unavailable. A cancellation normally prevents future renewals; access through an already-paid term depends on the payment-provider settings and the cancellation confirmation. Trial cancellation before the trial end prevents the first monthly subscription charge.
Refund eligibility, any mandatory withdrawal rights, and billing corrections are governed by applicable law and the terms shown by the merchant of record at Checkout. Nothing in these Terms limits non-waivable rights. Do not assume that a refund is automatic merely because a subscription has been cancelled.
7. Data connections, authorisation and read-only operation
You may connect marketing and commerce services, including supported Google, Meta, TikTok and WooCommerce resources, through their own authentication and permission processes. You must have authority to connect each account, property and data source and must respect third-party platform terms.
Growwwy is designed to access connected marketing data on a read-only basis. We do not promise that every provider, metric, account type or API capability will always be available. Third-party API limits, permission changes and outages can affect results. You control source authorisations and can revoke connections in the relevant provider or Growwwy interface where supported.
8. AI assistants, MCP and accuracy of outputs
Growwwy can expose permitted data and analytical tools to compatible AI clients using the Model Context Protocol (MCP). Third-party AI applications, including ChatGPT, Claude and Gemini where supported, have separate accounts, subscriptions, terms and privacy practices. A Growwwy subscription does not include their fees.
AI-generated analyses and statistical comparisons may be incomplete, delayed or inaccurate. Outputs are decision-support material, not a guarantee of future marketing performance, financial returns, legal compliance or accounting correctness. Review data quality, attribution assumptions and high-impact recommendations before acting.
9. Customer data, confidentiality and privacy
You retain ownership and control of the data and materials you lawfully connect or submit. You grant us the limited rights necessary to authenticate connections, operate the service, generate the requested results, maintain security and provide support.
Account and website visitor personal data are handled under the applicable Privacy Policy. Where Growwwy processes personal data on behalf of an organisation as a processor, a GDPR-compliant data processing agreement (DPA) must be in place, including applicable subprocessor and transfer arrangements, before that processing is initiated. These Terms alone are not intended to replace such a DPA.
Do not connect sensitive or special-category personal data unless there is a documented lawful basis, the necessary agreements and appropriate safeguards. You are responsible for your collection notices, lawful access to connected data and instructions you provide.
10. Security and responsible use
We use reasonable technical and organisational safeguards, such as access controls and encrypted handling of relevant secrets, but cannot guarantee that any internet service is entirely risk-free. Do not share access tokens publicly; follow least-privilege principles and revoke compromised credentials promptly.
You must not use the service to access data without permission, bypass provider controls, interfere with service availability, reverse engineer security mechanisms unlawfully or submit malicious content. We may temporarily restrict access where reasonably necessary to address security or abuse.
11. Service availability and changes
We aim to provide a reliable service but do not promise uninterrupted or error-free operation. Maintenance, third-party service changes, provider outages and security issues can affect availability. We may update, replace or discontinue features with reasonable notice where practicable, subject to applicable contractual and legal duties.
12. Intellectual property
Growwwy software, documentation, site design and branding remain owned by their respective rights holders. Subject to payment and compliance with these Terms, we grant you a limited, non-exclusive and non-transferable right to use the subscribed service during the applicable subscription period.
You retain rights to your own data. Third-party provider and AI platform names, logos and products remain subject to their respective owners’ rights and terms.
13. Responsibility and liability
Each party is responsible for its own breach of these Terms and applicable law. To the extent permitted by applicable law, the service is provided without guarantees of specific campaign outcomes, revenue or business results. We are not responsible for failures arising solely from third-party accounts or services outside our reasonable control.
Nothing in these Terms excludes or limits liability that cannot lawfully be excluded, including liability for fraud, intentional misconduct, or any statutory consumer or data-protection rights. Any commercial limitation of liability for business customers should be agreed in a reviewed contract; no unreviewed fixed cap is imposed here.
14. Suspension and termination
We may suspend access where a payment is overdue, credentials are compromised, use breaches these Terms, or continued access poses a material security or legal risk. Where feasible, we will give notice and an opportunity to resolve the issue. Either party may terminate for material breach under applicable law.
On termination, you should export the data and reports available to you before access ends. Data deletion, retention and return obligations are subject to the applicable Privacy Policy, DPA, law and technical backup retention schedules.
15. Updates to these Terms
We may update these Terms to reflect service changes, legal requirements or new providers. The effective date and version appear at the top of this page. For material changes, we will provide appropriate notice and request renewed acceptance where legally or contractually required. Previous acceptance records will not be silently overwritten.
16. Applicable law and disputes
Subject to mandatory rules and rights that cannot be waived, these Terms are governed by Hungarian law. The parties should first try to resolve complaints through elemer@growwwsites.com. Mandatory consumer jurisdiction and other non-excludable rights remain unaffected.
17. Contact and related documents
For subscription, access or legal questions, email elemer@growwwsites.com. Related documents: Privacy Policy, Cookie Policy, and the separate Data Processing Agreement where agreed, and the Subprocessors register.
